Thursday, January 22, 2026 - The Chairperson of the Presidential Council of Economic Advisors, David Ndii, has dismissed the High Court’s declaration that the offices of Presidential Advisors are unconstitutional, terming the ruling a “pyrrhic victory.”
Reacting to the ruling on X, Ndii argued that the decision will
not stop him or other advisors from continuing to guide President William Ruto,
noting that he had advised the Head of State informally long before his
election.
“We don’t need state offices to advise the President. We supported
him for two years on the road to victory.”
“We can do it as an informal kitchen cabinet over breakfast every
morning,” he said.
His remarks came hours after Justice Bahati Mwamuye ruled
that the creation of the advisory offices and the appointment of 21 individuals
to those positions had no legal basis.
The court quashed all related decisions, faulting the Government
for bypassing the Public Service Commission (PSC) and failing to consult the
Salaries and Remuneration Commission (SRC).
Justice Mwamuye further held that the appointments
undermined the spirit of the 2010 Constitution by ignoring mandatory procedures
for establishing public offices.
“The process violated the express letter and undermined the spirit
of the Constitution by bypassing the independent recommendatory role of the
PSC,” the judge stated.
Ndii was appointed Chairperson of the Presidential Council
of Economic Advisors on October 14th, 2022, alongside Mohammed
Hassan and Nancy Laibuni.
Since then, President Ruto has expanded his team of advisors
with the number estimated at more than 21.
