03, 2025 - Nelson Amenya, the whistleblower who previously exposed the
controversial Adani deal, has returned with another explosive allegation - this
time targeting a proposed health security agreement between Kenya and the
United States.
On Tuesday, December 2nd, Amenya claimed that
President William Ruto’s administration is preparing to sign a 25-year accord
with U.S President Donald Trump’s Government.
The deal will grant Washington real-time access to Kenya’s
national health records, including sensitive information such as HIV status, TB
treatment, and vaccination histories.
“It will give the U.S government real-time access to all
Kenyan health records - everything,” Amenya alleged.
He further claimed that disease specimens collected from
Kenyan patients will be shared with up to ten American pharmaceutical
companies.
Amenya highlighted a clause stipulating that the agreement will
be governed by U.S. federal law, effectively sidelining Kenyan legislation in
the event of a breach.
“Your data protection rights simply don’t exist under this
agreement. The Office of the Data Protection Commissioner becomes completely
powerless,” he said.
Describing the proposal as unconstitutional, Amenya argued
that it contravenes the Kenya Data Protection Act, the Health Act, and the
Digital Health Act.
He warned that the U.S will gain 24-hour access to Kenya’s
health databases and the authority to conduct random audits of five percent of
health facilities at will.
He added that the U.S will also secure free access to
disease specimens for vaccine development, with no guaranteed benefits for
Kenya over the next quarter century.
“We are talking about the medical privacy of 50+ million
Kenyans being handed over to a foreign Government under foreign law,” Amenya
stated.
Amenya concluded by claiming that failure to comply with the
agreement could expose Kenya to heavy funding cuts.
President Ruto is currently in the U.S to witness the signing of the historic DRC-Rwanda Peace Agreement alongside Presidents Paul Kagame and Félix Tshisekedi.
