2025 - Presidential hopeful and former Chief Justice David Maraga has
condemned President William Ruto’s swift assent to eight contentious bills,
including the Computer Misuse and Cybercrimes (Amendment) Bill, 2024, immediately
after the death of opposition leader, Raila Odinga.
Speaking in Nairobi, Maraga accused the Government of
rushing legislation that undermines constitutional freedoms and lacks public
participation.
He warned that the laws - passed and signed on October 15 - could
have far-reaching consequences, especially the cybercrime bill, which grants
authorities sweeping powers to restrict online platforms without judicial
oversight.
Maraga claimed that the move was designed to preempt legal
challenges and render court interventions ineffective.
''The
government knows people are going to court.”
“They
are moving with speed so that by the time we obtain court orders, events will
have overtaken us,'' Maraga said.
He revealed that civic groups and opposition leaders are
preparing legal action to suspend the laws’ implementation.
“These amendments are unconstitutional, null, and void.
President Ruto has lost legitimacy to continue governing this country,” Maraga
declared.
'We
cannot allow these freedoms to be buried silently as efforts are underway to
seek court intervention, and we fully support these efforts.'' He added.
President
Ruto signed the eight bills into law, which include the National Land
Commission (Amendment) Bill, 2023; Land (Amendment) Bill, 2024; Wildlife
(Amendment) Bill, 2023; Computer Misuse and Cybercrimes (Amendment) Bill, 2024;
National Police Service Commission (Amendment) Bill, 2024; Air Passenger
Service Charge (Amendment) Bill, 2025; Virtual Asset Service Providers Bill,
2025; and the Privatisation Bill, 2025.
