2025 - The Judicial Service Commission (JSC) has launched investigations
into bribery allegations against Justice Fred Nyagaka, following claims that he
received a Ksh10 million bribe but ruled against the party who allegedly paid
him.
In a statement released on Monday, September 22nd,
JSC Secretary Winfridah Mokaya confirmed the commission had taken note of the
accusations circulating on social media and had commenced formal
investigations.
“The Commission reaffirms its unwavering commitment to
uphold integrity and ensure accountability within the Judiciary, in full
adherence to the rule of law,” the statement read.
The scandal surfaced after lawyer Nelson Havi shared a
letter from complainant Ben Limo, who accused Justice Nyagaka of accepting the
bribe through an intermediary with the promise of delivering a favourable
judgment.
Instead, Nyagaka reportedly ruled against Limo, prompting
demands for a refund.
“I have exercised immense patience and attempted to resolve
this matter quietly,” Limo wrote in the letter dated August 25th.
“Despite receiving the funds in full, you failed to fulfil
your part of the bargain. You promised to repay Ksh 5 million after securing a
bank loan, but no payment has been made.”
Limo issued a final demand for the full refund within seven
days, warning of public legal action if the matter remained unresolved.
The controversy deepened after Standard Media Group
journalist, Collins Kweyu, who was investigating the case, was arrested in
Migori County and later released on a free bond.
He was ordered to report to the local Criminal Investigation
offices next week.
“They’re still holding my phone, but I won’t be cowed. The
work must continue,” Kweyu said.
The JSC has pledged to keep the public informed as
investigations unfold.
