Monday, June 16, 2025 - Former Chief Justice David Maraga has demanded the immediate arrest of Inspector General of Police Douglas Kanja, Deputy IG Eliud Lagat, and DCI Director Mohamed Amin over the death of teacher and blogger Albert Ojwang in police custody.
Speaking on Monday, June 16th, Maraga accused the
three of giving false statements under oath regarding the abduction and murder
of Ojwang, who died in police custody under mysterious circumstances.
The former CJ gave authorities until June 25th to
act, warning that failure to arrest and prosecute the trio would prompt him to
join citizens in initiating private prosecution.
“There is prima facie evidence that Mr. Lagat, directly or
indirectly, is implicated in the illegal arrest, torture, strangulation, and
eventual murder of Albert Ojwang.”
“Yet he still remains in office,” Maraga said.
He accused the National Police Service, Directorate of
Criminal Investigations, and Independent Policing Oversight Authority of lying
to the public and argued that their conflicting accounts have eroded public
trust.
“To begin the process of resetting our justice system, the
IG, DCI boss, and Deputy IG must be arrested and prosecuted along with all
those responsible,” he stated.
Maraga expressed support for Kenyans already pursuing
private prosecution and warned that if the DPP fails to act, citizens have
constitutional authority to seek justice directly.
He further criticized President Ruto’s reaction to the
death, describing it as “callous and calculated,” and said the Head of State
was evading responsibility for police brutality under his administration.
He also backed planned nationwide protests on June 25th
- the anniversary of the 2024 Gen-Z demonstrations - where police allegedly
killed and abducted dozens of youth protesting against the Finance Bill.
