2025 - Prominent Nairobi lawyer, Donald Kipkorir, has won a constitutional
petition against Muthaiga Country Club, with the High Court awarding him Ksh 1
million in damages.
In a statement issued Friday, November 7th,
Kipkorir said Justice Chacha Mwita ruled that the club violated his
constitutional rights by denying him entry despite being invited by a member.
“Justice Chacha Mwita, one of our finest judges in mind and
character, held that MCC violated my rights and cannot refuse me entry if I’m
invited,” Kipkorir stated.
He praised the court’s decision as a victory for
constitutional justice and thanked his lawyer, Peter Wanyama, for standing firm
in the litigation.
The court also awarded Kipkorir legal costs, reinforcing the
principle that private institutions must respect the rights of invited guests.
Kipkorir further called on Muthaiga Country Club to abolish
its controversial ‘blackballing’ policy, which allows members to anonymously
block guest access or membership.
“MCC should end its ‘blackballing’ policy where members with personal vendettas hide in shadows like weasels,” he said.
