2026 - The Family Court in Nairobi has dismissed an application by former
East African Court of Justice Judge, Charles Nyachae, seeking to remove his
stepmother, Grace Nyachae, and stepbrother, Leon Nyachae, from managing the
estate of their late father, former Cabinet Minister and billionaire
businessman Simeon Nyachae.
In a ruling delivered on June 19th, 2026, Justice
Rose Oganyo held that Charles had failed to prove allegations of mismanagement
or unlawful interference with the estate’s administration.
The dispute arose after Simeon Nyachae’s death in February
2021.
His will appointed Charles Nyachae, Angela Mochache and Eric
Maina Nyachae as executors.
The majority of executors resolved that Sansora Group of
Companies, directed by Grace and Leon, would continue managing the estate’s
properties, an arrangement established by the deceased in 2015.
Charles moved to court in 2022, claiming that Sansora had
unlawfully taken over management and collected rental income without authority.
He accused his co‑executors of abdicating their duties and
sought to replace Sansora with Ark Consultants Limited.
He also demanded a full account of rental income since 2021.
Justice Oganyo dismissed the claims, noting that Sansora had
been appointed through a written agency agreement dated December 1st,
2015, and later ratified by the majority of executors under Clause 16 of the
will.
“Allegations of intermeddling must be supported by parcel‑specific
or independent evidence demonstrating that assets have been wasted, alienated
or placed at risk, which is entirely absent in the present case,” she ruled.
The court further upheld the majority‑decision clause in the
will, stressing that overriding it would defeat the testator’s clear intention
and ordered Sansora Group to continue managing the estate, dismissing Charles
Nyachae’s application in its entirety.
