Kisumu man handed 50 year prison sentence over ‘senseless and deliberate’ murder and blaming it on intoxication and temporary insanity



Tuesday, June 09, 2026 - The Office of the Director of Public Prosecutions (ODPP) has confirmed a 50‑year custodial sentence against Sebby Roy Oyugi, a Kisumu man found guilty of murdering David Omondi Haya in 2021.

On Tuesday, June 9th, the ODPP announced that Justice Joe M. Omido of the Kisumu High Court had delivered the guilty verdict on April 16th and imposed the sentence on June 8.

“The Director of Public Prosecutions (DPP) has secured a conviction and a fifty (50)‑year custodial sentence against a 48‑year‑old Sebby Roy Oyugi for the murder of David Omondi Haya, following a judgment delivered by Hon. Justice Joe M. Omido at the Kisumu High Court,” the ODPP stated.

According to prosecutors, Oyugi armed himself with a knife from a mutura vendor, chased the unarmed victim and stabbed him once in the back.

The blade pierced the chest cavity, damaging the left lung and causing fatal haemorrhage.

Two eyewitnesses testified they saw Oyugi pursue and stab the victim before fleeing on a motorcycle.

DNA evidence confirmed the blood on the recovered knife matched the deceased.

Prosecutor Mercy Mutheu Muema built the case around nine witnesses and forensic evidence, arguing that Oyugi acted with clear intent to kill.

Justice Omido ruled the attack was deliberate and senseless, rejecting Oyugi’s defence of intoxication and temporary insanity.
