Thursday September 19, 2019-Slain Dutch tycoon, Tob Cohen‘s body will not be released to anyone except to his wife Sarah Wairimu, lawyer Philip Murgor has said.
Murgor, who is representing Wairimu in the murder case, said it is only Wairimu who has a constitutional right to bury her husband and not his sister Gabrielle.
"The sister has no legal right over the body. We have rejected her demand and have written to Chiromo Morgue not to release that body to anyone, but Sarah Cohen," Murgor told journalists in Nairobi on Thursday.
Murgor insisted Wairimu was fully aware of the wishes of her late husband, “none of which includes being buried within the shortest time possible".
"Our client demand that the remains are not released to Gabrielle Cohen as she has no legal authority or mandate to take our client's husband's body, let alone to bury him,"
"It is not our client who must get a court order to bury her husband. To the contrary, it is the sister who does not live in Kenya who must get a court order,"Murgor said
Murgor even displayed the couple’s marriage certificate saying Wairimu is still legally married to late Cohen despite being the chief suspect in the murder.
