Friday June 14, 2019 - Chief Justice David Maraga suspended Kiambu Principal Magistrate, Bryan Khaemba, on Thursday over gross misconduct.

In a letter dated 13th June, Maraga said he suspended the Magistrate after he issued anticipatory bail to Governor Ferdinand Waititu despite the fact that the case was not in his jurisdiction.

However, in a response on Friday, Khaemba denied any wrongdoing but noted that since the suspension was indefinite, he had to resign.

"Having reflected on the consequences of the suspension letter, especially on the aspect of nil salary and the fact that this process has no definite timelines, I have separately tendered my resignation letter to enable me engage in other income generating activities," Khaemba said in his letter.

This means that Khaemba will be paid his full benefits by the Judiciary since he resigned before being investigated by the Judicial Service Commission (JSC).

 “Yes he outwitted Chief Justice by resigning, he will now enjoy full benefits after he resigned. Kenya taxpayers will pay him,” said a lawyer who is privy to Khaemba‘s resignation move.
