Blow to WAVINYA NDETI as IEBC moves to court to confirm that ALFRED MUTUA beat fair and square in the 2017 polls

Friday July 13, 2018-The Independent Electoral and Boundaries Commission (IEBC) has petitioned the Supreme Court to overturn the Court of Appeal's nullification of the election of Machakos Governor Alfred Mutua.

This is after the Court of Appeal in Machakos overturned the High Court decision that had upheld his win, saying the Machakos Gubernatorial election was not free and fair and that Alfred Mutua was not validly elected as Machakos Governor.

Through its lawyer Kimani Muhoro, the IEBC is now seeking several reliefs in the highest court, among them, a declaration that Dr. Alfred Mutua was validly elected and declared Governor.

According to IEBC, the Supreme Court should make a declaration that they conducted the Machakos County Governorship election in a free, fair and a credible manner and in accordance with the Constitution of Kenya, the Election Act and other relevant laws.

Court of Appeal judges William Ouko, Mohhamed Warsame and Gatembu Kairu nullified Mutua’s election following the appeal lodged by former Kathiani MP Wavinya Ndeti, who lost to Mutua.
