Justice Luka Kimaru expressed disappointment after the Government once again failed to present the accused (Miguna) before him as was ordered.

"Immigration boss Kihalangwa must swear an affidavit to say how he got hold of the suspect while he knew he was in the custody of the court," Kimaru ruled.

Kimaru also demanded that Inspector General of Police (IG), Joseph Boinett, and Directorate of Criminal Investigations (DCI) boss, George Kinoti, file affidavits to explain why they should not be punished for defying earlier court orders.
