RUTO’s lawyer, KARIM KHAN, to request for the DISMISSAL of the ICC cases- for LACK OF WITNESSESNews 04:43
Thursday September 12, 2013 - The battery of lawyers representing Deputy President, William Ruto, at the International Criminal Court (ICC), are likely to press for early dismissal of Ruto’s case when court resumes its hearing on Tuesday.
According to Ruto’s lead lawyer, Karim Khan, they are mystified that after all the months of preparation; Ms Bensouda could not produce her first witness on the opening day, explaining that he was still travelling to The Hague.
The lack of witnesses against Mr Ruto prompted Mr Khan to charge that the prosecution’s case was crumbling before it started .He then launched an aggressive opening strategy that legal experts say was to press for the case to be dismissed early.
At the end of hearing on Wednesday, Mr Khan challenged Ms Bensouda to concede early that her case was fatally defective and withdraw it in the interest of justice.
Now Khan and his lawyers are currently preparing a motion that will convince the three judge bench at the ICC that the ICC Prosecutor, Fatou Bensouda, has no evidence that can sustain a full hearing.
They want the Judges to throw out the case on Tuesday.
